GREAT GOATS LANDSCAPING, INC., herein after referred to as "Contractor" and Property Owner, herein after referred to as "Owner" enter into this agreement voluntarily and mutually for the work detailed on the front of the Agreement.
Contractor agrees to provide all labor, equipment, tools, supplies and supervision to perform all work as specified in this Agreement in a professional and workmanship like manner. Any changes, alterations, additions or deletions to the scope of work as provided herein, shall be in writing and signed by both parties. If Owner is not satisfied with any of the work performed by Contractor, Owner must notify Contractor IN WRITING at the time of the final inspection walk through with the Contractor at conclusion of the work. When Owner submits final payment for the work after completion, any and all claims made by Owner, excluding warranty claims as specified herein, will be null, void and otherwise prohibited.
Additional work requested and additional enhancements will be at an hourly rate of $72.55 per man hour, including equipment, tools and miscellaneous costs.
To secure this work for you, a 50% deposit is required to be paid by you so we may confirm, guarantee the total cost and to schedule this work for you. If you should cancel this agreement before any work is started, we will refund you ninety percent (90%) of your deposit and retain ten percent (10%) for our costs to process this project. Costs include selecting and planning materials and plantings, reserving a date and time for doing the work and for preparation for the project. If you chose to defer the work to the next year or season, we will retain the full deposit and guarantee that the price proposed to you will not increase for 12 months.
Upon completion of the work, you and our representative will conduct a walk-through to review the completed work. Before you make the final payment, you and our representative will examine the work and assure you are completely satisfied. You will be given a walk-through note sheet where you will be able to document any items of concern or that you wish to be addressed. Once all work is completed to your satisfaction, you will sign the final walk-through document stating that you have no issues with the work and no claims against us as a result of the work. Signing this document WILL NOT void the warranty or the extended warranty that applies or may apply to this agreement.
The final payment for the work and any agreed changes to the work is due immediately upon your signing the final walk-through inspection and approval document. If mutually agreeable final payment terms are not accomplished, we reserve our right to begin the removal of materials we furnished and installed such as boulders, trees, shrubs, bushes or other tangible materials. If we are asked to reinstall any removed materials, we will do so with an advanced payment of our estimated time and equipment plus the full final payment — BEFORE the reinstall process commences.
Contractor warrants all planting items such as shrubs, trees, perennials, evergreens, bushes, sod and other living plants for 3-months (90-calendar-day) after completion of the work. Warranty for this three months (90-calendar days) includes the cost to furnish, deliver and install new plantings of the same or similar like, kind and quality. (Grass seed is warranted for only 30-calendar days) Owner is required to email notice of "dead or dying" plantings within three months (90-calendar-days) to greatgoatslandscaping@yahoo.com before the 90-calendar-day warranty period expires. Any notice emailed after the 90-calendar-day warranty expires will be null, void and otherwise prohibited. Contractor will perform first watering of all plantings. After this first watering, Owner shall follow the plant growers instructions for watering and caring of the plantings that will be furnished to the Owner by the Contractor upon completion of the work.
Owner can purchase an extended warranty from Contractor for an added cost of 14% of the landscape item total or for a lump sum as reflected on this agreement. This extended warranty will extend the 90-calendar-day warranty for a period of one additional year: 365-days beyond the 90-calendar-days for a total of 475-calendar-days. This extended warranty covers the furnishing, delivery, removal of the dead or dying planting and replacing with a new plant of the same or similar like, kind and quality. This warranty WILL extend to dead or dying plantings that were not watered properly or die for any reason. There is a limit of one (1) replacement plant only for every one dead or dying plant. If Owner chooses this extended warranty, please sign on front. Initial if Owner declines extended warranty.
Contractor shall be responsible for any damage to the Owner's property as a result of Contractor negligence in the performance of the work. Contractor shall contact GopherOneCall to locate public underground utilities such as gas, electric, communication or water/sewer. Owner shall mark all privately installed underground utilities such as gas lines to grill or fixtures, underground fences, irrigation systems, underground electrical to fixtures, outlets or lighting, low voltage lighting or any other Owner installed cables, pipes, lines or fixtures. Contractor will NOT be liable for any damage to Owner installed lines, pipes, cables, fixtures, systems of any kind unless specifically included in the scope of work.
Contractor carries and maintains Commercial Contractor's General Liability Insurance, Worker's Compensation Insurance and Automobile Liability Insurance coverages.

Any dispute between Contractor and Owner or Owner and Contractor shall be in the Hennepin County, State of Minnesota and under the laws and jurisdiction of the State of Minnesota.
